Tree feel on my truck last Jan. The owner of the tree was insured by Nationwide who denied the claim said it was "Act of God"; but the tree had heart rot.

They refused to pay for my damages and treated me like a dog and now they have hired a lawyer who is no better than they are. The owner of the tree has yet to contact in which Nationwide did a very crummy and poor job from their adjuster all the way to their claims manager who refused me an appeal or copy of claim to verify their fair investigation of the claim which I feel never happened in which they only took their insured words.

Reason of review: Poor customer service.

Your claim should have been filed with your car insurance as a comprehensive claim. You had no valid claim against your neighbor, which is why you were denied.

A healthy tree that falls or loses a limb during a storm or other weather related incident is considered an act of God, and not claimable. There is no insurance company that would have paid that claim on your neighbor's home insurance. Heart rot or not, they obviously determined that it was a healthy strong tree that fell due to weather.

Claim it on your comprehensive, then your insurance can decide whether or not to subrogate against your neighbor, if they do and if they win the case then they will repay your deductible to you.
